The present General Terms and Conditions of Sale (GTCS) apply to the sale of EMPREINTE articles on the website by:
The company EMPREINTE, SAS with a capital of 2,000,000 euros, located at Brest 29200 - 5 rue de l'Eau Blanche, represented by its President, Mrs. Magalie Le Banner, registered in the Trade and Companies Register under the number 635 620 719. Intra-community VAT number: FR 85 635 620 719.
Before confirming your order on the website, you will be informed of the exact identity of the seller by clicking on the link to the General Terms and Conditions located above the “Proceed to Payment” button. The seller’s identity will also be indicated on the invoice available from your customer account.
Placing an order implies full acceptance of these General Terms and Conditions of Sale, accessible at any time on the website, especially when registering the order. Please print and keep a copy of these General Terms for future reference. Unless proven otherwise, the data recorded by us constitutes proof of the transactions and their date.
The General Terms and Conditions of Sale constitute the sole agreement between the parties and prevail over any other document. They may be modified at any time. The new General Terms and Conditions of Sale will apply to any order once they are posted online on the website.
Orders placed on the website are reserved for individuals acting as "end consumers." The resale of EMPREINTE items is strictly prohibited to any buyer engaging in commercial activity with them.

ARTICLE 1 – ITEMS OFFERED FOR SALE ON OUR WEBSITE
A selection of lingerie and swimwear collections from the EMPREINTE brand. The items offered are subject to availability. Information regarding the availability of items is provided at the time of ordering.
ARTICLE 2 – UNIT PRICES OF ITEMS AND TOTAL ORDER AMOUNT
The prices of the items are indicated inclusive of all taxes (VAT at the rate in effect on the date your order is recorded), excluding shipping fees. They are shown in the currency of your choice.
Prices may be changed at any time, it being understood that items are billed based on the rate in effect at the time the order is recorded.
The total amount of the order you intend to place is visible at each step of the order confirmation.
ARTICLE 3 – ORDER
The Customer is invited to select the chosen products and add them to the cart by clicking on the "Add to Cart" button. At any time, the Customer can remove products from the cart by clicking on the "Cart" icon displayed at the top right of every page of the website, on both desktop and mobile versions.
The Customer is encouraged to review their order summary by clicking on the "Cart" icon. At this stage, they can check the order details, correct any selection errors, change quantities, or delete one or more items.
After confirming the cart by clicking on the "Confirm My Cart" button, the customer is invited to log in with their username and password to place an order through their customer account or, if they do not yet have an Empreinte account, to create one.
Empreinte cannot be held responsible for any inaccuracies in the information provided by the Customer. The customer account provides access to a personal space where it is possible to update personal information, track orders and returns, view order history, access invoices, and manage a wishlist.
To finalize an order, the Customer must:
Confirm the delivery and billing address.
Select the delivery method from those offered (delivery times and costs vary depending on the delivery method and are indicated at this stage).
Explicitly read and accept these GTCS by checking the box "I have read and accept the General Terms and Conditions of Sale" before proceeding to payment.
Pay the amount of their order by clicking on the "Proceed to Payment" button, which gives access to the secure payment of the order.

EMPREINTE reserves the right to refuse to execute an order if it is abnormal, abusive, or contrary to the provisions of the GTCS. Likewise, Empreinte cannot be held responsible if the proper administrative or technical process of an order on the website is disrupted by a virus, computer bug, unauthorized human intervention, or any other cause beyond the control of Empreinte, or in case of suspected fraud or confirmed fraud, particularly computer-related. In such cases, Empreinte reserves the right to suspend or cancel the ongoing order. The Customer will then be informed by email of the order cancellation and will be refunded any amounts paid before the cancellation.
A shipping confirmation email will be sent when the carrier takes charge of the order.
The invoice will be available online in your customer account.
ARTICLE 4 – PRODUCT AVAILABILITY
The products are offered within the limits of available stock. Information regarding product availability is provided on the product page and confirmed when the order is placed. If, despite EMPREINTE's efforts, the ordered products are no longer available, EMPREINTE will inform you by email as soon as possible. The refund for unavailable products will be processed to your bank account.
ARTICLE 5 – PAYMENT
Payment for your purchases is made by the payment method available based on your delivery country and in the currency of your choice. This may include credit card as well as other payment methods (such as Apple Pay, Google Pay, Klarna, PayPal, etc.).
Your purchases are made securely, as the confidentiality of the banking information you transmit via the website to an accredited banking institution is ensured in a secure environment (SSL protocol).
We also reserve the right to request additional documents (photocopy of ID card, proof of residence, etc.) to validate your purchase and ship your parcel. These requests will be made by email.
We retain ownership of the items sold until full payment of the price, including taxes and shipping fees.
ARTICLE 6 – DELIVERY
We deliver internationally exclusively with DHL. Your purchase will be delivered to the address you provided when placing the order. The items are insured by us until delivery.
6.1. DELIVERY
Your order will be prepared in our warehouses located in Brest (France) within a maximum of 72 business hours before being handed over to the DHL carrier. We offer international shipping.
Depending on your country, you can choose from the following options:
Standard Courier: Delivery within up to 3 business days (for orders placed before 12 PM, Monday to Friday).
Express Courier (by air): Delivery within up to 2 business days (for orders placed before 12 PM, Monday to Friday).

6.2. DELIVERY – TIMEFRAMES
If you have not received your order within the indicated timeframe:
If you have received a shipping confirmation email but have not received your order within the indicated time, please contact our Customer Service online via the contact form.
If you have not received a shipping confirmation email and the 3-week period has passed, contact our Customer Service online via the contact form.
If you have received a shipping confirmation email but your order has not arrived within 7 days after the scheduled delivery date, for reasons other than force majeure, you may cancel the order (by registered mail with acknowledgment of receipt as stipulated in Article L121-20-3 of the French Consumer Code).
You may exercise this right if there is a delay of 60 business days from the scheduled delivery date. However, we ask that you first contact our Customer Service via the contact form. After verification, they will provide you with instructions on how to return the item(s). You will be refunded all amounts paid (including delivery fees paid at the time of ordering the affected product(s)) within a maximum of 15 days from the date you exercised your right.
6.3. DELIVERY – RECEIPT AND CLAIMS
Upon receiving your order, please systematically check the condition of your package and the ordered item. If you notice that your package or item has been damaged, please note this on the delivery receipt provided by the carrier and immediately contact our Customer Service via the contact form. In your message, don't forget to describe the damages (e.g., wet package, holes, opened, etc.).
In all cases, you have a period of three (3) days, excluding public holidays, from the date of receipt of your package to inform the carrier. We also ask that you keep the shipping packaging.

ARTICLE 7 – RETURNS
7.1 HOW TO MAKE A RETURN?
You can return your items within 30 days from the date you received your order. For assistance with the return process, detailed instructions are available in our FAQ.
Return shipping costs are at your expense. All our products are shipped from France. To reduce the number of returns and limit our carbon footprint, we encourage you to double-check your size before placing an order using our size guide or by contacting our advisors via our online form. We do not offer exchanges.

7.2 REFUNDS
I returned an item and haven't been refunded
For returned items, it may take up to 21 business days for the funds to be credited back to your original payment method, as the following steps must be completed:
Delivery time for the return to reach our warehouse
Processing and inspection for refund approval
Financial department authorization to issue a refund
It may take up to 7 business days for the funds to be credited to your payment method once the financial department has processed the refund.
If your refund has not been issued within 21 business days, please send us the tracking number of the returned package so we can obtain more information.
ARTICLE 8 – WARRANTIES AND LIABILITY
8.1. EMPREINTE WARRANTY
The items offered are in compliance with current regulations and benefit from the expertise and quality of EMPREINTE. As a result, they are guaranteed against any manufacturing defects. In the event of a defect, EMPREINTE undertakes to repair your purchase free of charge or exchange it. When exchanging an item, defective products are not returned.
The EMPREINTE warranty does not cover normal wear and tear, accidental damage, or damage caused by improper washing or abnormal use of the garment. Machine washing damages our products and is therefore not covered under the EMPREINTE warranty. If you wish to take advantage of the EMPREINTE warranty, please contact our customer service via the contact form.
8.2. LIABILITY
We are not responsible for any potential color discrepancies between the screen and the actual products.
Additionally, we cannot be held liable or responsible for any delays or non-performance resulting from a force majeure event. Lastly, please note that we are not liable for any order placed by a minor, regardless of whether the parents have authorized the order or not.
ARTICLE 9 – DOCUMENT RETENTION
For any order exceeding €120 (incl. VAT), we commit to keeping the transaction documents for a period of 10 consecutive years. We guarantee you access to these documents at any time, upon request.
ARTICLE 10 – PERSONAL DATA
Your personal data is necessary for processing your order and will never be sold, traded, or rented to third parties. This information may also be used for statistical purposes, marketing analysis, and customer relationship management.
If you choose to subscribe to our commercial offers, we may send you promotional offers or news about the EMPREINTE brand by mail, email, SMS, or phone, depending on the communication method(s) you have chosen.
You may withdraw your consent for the processing of your personal data for these purposes at any time, with the exception of the processing and tracking of orders. Your personal data is collected on behalf of EMPREINTE, as the data controller. This data may also be transmitted to our service providers located within the European Economic Area (EEA). Due to the international scope of EMPREINTE and to improve the quality of our service, your personal data may be transferred outside the EEA. However, EMPREINTE ensures that the necessary measures have been taken to provide adequate protection of your privacy and freedoms to allow for the secure transfer of your data.
In any case, the information collected is strictly confidential and protected to prevent it from being altered, damaged, or accessed by unauthorized persons.
However, EMPREINTE is committed to ensuring that your personal data is not retained longer than necessary for the purposes described above.
In accordance with the French Data Protection Act No. 78-17 of January 6, 1978, as amended, and the EU General Data Protection Regulation (EU) 2016/679 of the European Parliament and Council of April 27, 2016, you have the right to access, rectify, delete, and port your personal data, as well as the right to object to and restrict its processing. ARTICLE 11 – INTELLECTUAL PROPERTY
The intellectual property rights of the website and its components (trademarks, designs, copyrights, domain names, etc.) are subject to ownership and exclusive use by EMPREINTE. Any total or partial reproduction of the website without the express authorization of EMPREINTE is prohibited, except for personal and private use, excluding any commercial purposes.
ARTICLE 12 – APPLICABLE LAW - DISPUTES
These General Terms and Conditions of Sale, the order, and any resulting actions are governed by French law. French courts shall have exclusive jurisdiction in the event of a dispute or failure to reach an amicable resolution.
