These General Terms and Conditions of Sale apply to the sale of EMPREINTE items on the site by:  The company EMPREINTE, SAS with a capital of 2,000,000 euros, located in Brest 29200 - 5 rue de l'Eau Blanche, represented by its Chairman Mr Philippe Berthaux, registered in the Trade and Companies Register under number 635 620 719. EC VAT number: FR 85 635 620 719.

Before confirming your order on the website, you will be informed of the exact identity of the seller, by clicking on the link to the General Terms and Conditions located above the "Proceed to Payment" button. The seller's identity will also be indicated on the invoice available from your customer account. 

Making an order implies full acceptance of these General Terms and Conditions of Sale, which are accessible at any time on the site, particularly when the order is registered. Please print and keep a copy of these Terms and Conditions for future reference. In the absence of proof to the contrary, the data recorded by us constitutes proof of the transactions and their date.

The General Terms and Conditions of Sale are the only agreement between the parties and prevail over any other document. They may be changed at any time. The new General Terms and Conditions of Sale will be applicable to all orders once they have been made available on the site.

Orders made on the site are reserved for private individuals who are "end buyers". The resale of EMPREINTE items is strictly forbidden to any buyer who trades in them on a professional basis.

 ARTICLE 1 - ITEMS OFFERED FOR SALE ON OUR WEBSITE

A selection of articles from the lingerie and swimwear collections of the EMPREINTE brand. The items offered are subject to availability. Information on the availability of the articles is provided when the order is placed.

ARTICLE 2 – THE UNIT PRICES OF THE ITEMS AND THE TOTAL AMOUNT OF THE ORDER 

The prices of the articles are inclusive of all taxes (VAT rate in force on the day your order is registered), excluding transport costs. They are indicated in Euros.

They can be changed at any time, on the understanding that the articles are invoiced on the basis in force at the time the order is registered.

The total amount of the order you are planning to make is visible at each stage of the order confirmation.

ARTICLE 3 – THE ORDER 

The Customer is invited to select the chosen products and put them in the basket by clicking on the "Add to basket" button. At any time, the Customer may delete products on the page displaying their basket by clicking on the "Basket" icon displayed on all the pages of the site in the top right-hand corner on the desktop and mobile versions. 

The Customer is encouraged to check the summary of their order by clicking on the "Basket" icon. At this stage, they can check the details of their order, identify any product selection errors, change the quantities, or delete one or more items. 

After confirming the basket by clicking on the "Confirm my basket" button, the customer is asked to identify themselves with their user name and password in order to order using their customer account or, if the customer does not have an Empreinte account, they will be asked to create one.

Empreinte cannot be held responsible for the inaccuracy of information provided by the Customer. The customer account will give access to a personal space where you can change your personal information, track your orders and returns, consult your order history, access your invoices and access your wishlist. 

To finalise an order, the Client:

-        must confirm the delivery and billing address.

-        select the delivery method from those offered (delivery times and costs vary according to the delivery method and are indicated at this stage)

-        must read these GTC and explicitly accept them by ticking the box "I have read and accept the General Terms and Conditions of Sale" before proceeding to payment.

-        is invited to pay the amount of his order by clicking on the "Proceed to payment" button which gives access to the secure payment of the order. 

Once the order has been placed, the Customer will receive a printable order confirmation by email in lieu of an order form, containing:

-        the present General Terms and Conditions of Sale

-        contact details for our Customer Service Department 

EMPREINTE reserves the right to refuse to fulfil an order if it is anomalous, abusive or contrary to the provisions of the GTC. Similarly, Empreinte cannot be held responsible if the proper administrative or technical processing of an order on the site is disrupted by a virus, a computer bug, unauthorised human intervention or any other cause beyond the control of Empreinte, or if there is a strong suspicion of fraud, or that fraud has occurred in any form whatsoever, in particular in a computerised manner. In this case, Empreinte reserves the right to suspend or cancel the order in progress. In these cases, the Customer will be informed by email of the cancellation of his/her order and will be reimbursed for any sums paid prior to the cancellation of his/her EMPREINTE order. 

A shipment confirmation email will be sent upon collection by the shipping company. 

The invoice will be available online from your customer account. 

ARTICLE 4 – DISPONIBILITE DES PRODUITS 

The products are offered within the limits of available stocks. Indications of product availability are provided on the product page and confirmed when the order is placed. If, despite EMPREINTE's efforts, the products ordered are no longer available, EMPREINTE will inform you by email or telephone as soon as possible. The refund of the unavailable product(s) will be made to your bank account.

ARTICLE 5 – PAYMENT

Payment for your purchases is made solely by credit card when you place your order. Only Visa and Mastercard are accepted. 

Your credit card is debited immediately after your order is placed, in the currency of the order. You make your purchases in complete security, the confidentiality of the banking information that you transmit via the site to an approved banking establishment is handled in a secure environment (SSL protocol).

Payment card numbers are not stored on our site but on the secure site of a banking institution.

For payments made electronically, and to prevent the fraudulent use of payment methods on the Internet, we check the reliability of the information you enter when placing your order. In this way, we check that the credit card address matches the billing address. [TBC] 

We also reserve the right to request additional documents (photocopy of identity card, proof of address, etc.) to confirm your purchase and send your package. These requests will be made by e-mail or telephone. 

We retain ownership of the items sold until full payment of the price, including taxes and transport costs.  

ARTICLE 6 – DELIVERY

The items offered for sale will only be delivered in mainland France, including Corsica. Your purchase will be delivered to the address you indicated when you placed your order. We do not accept deliveries to an EMPREINTE-approved sales outlet, an EMPREINTE shop, a post office box or an address marked "Secteur Postal". The articles are insured by us until delivery. 

6.1. DELIVERY - TRANSPORT COSTS  

The transport costs and any customs duties are indicated during the ordering process before confirmation.

-        SO COLISSIMO - home delivery WITHOUT an appointment and without signature or in a parcel collection point or at the Post Office. Delivery time in France: D+2 to D+4. Deliveries by SoColissimo are made from Monday to Saturday. For orders of less than €150 including VAT, the delivery charge is €9 including VAT. For orders over 150 € including VAT, the shipping costs are paid by EMPREINTE.

-        CHRONOPOST:  Signed for. Delivery time in France: D+1 before 1pm (working day), if ordered before 12pm. Chronopost deliveries are made from Monday to Friday. Email and SMS notifications available Amount: € 24 (tax already included)

6.2. DELIVERY - TIMESCALES   

Once your order has been received, it will be processed within 48 hours. The average delivery period is 4 days.

You have not received your order in the time stated:

> If you have received an email confirming dispatch, but you have not received your order in the time stated please contact our Online Shopping Customer Support Service: [email protected]

> If you have not received an email confirming dispatch, but the 3 week deadline has passed, please contact our Online Shopping Customer Support Service: [email protected]

> If you have received an email confirming dispatch but you have not received your order within 7 days after the delivery date has passed for any other reason other than force majeure. You can, if you wish, cancel the order (by recorded mail with a return receipt requested under the conditions stipulated in article L121-20-3 of the Consumer Code).

You can exercise this right if a delay of 60 working days from the scheduled delivery date occurs. Nevertheless, we ask you to please contact our Customer Support department: [email protected]. After verification, this service will tell you the options available for the return of your item(s). You will be refunded all amounts paid (including delivery charges paid when the order for the product(s) concerned was placed) within a maximum of 15 days from the date when you exercised your right.

6.3DELIVERY - RECEPTION & RESERVATIONS

When you receive your order, systematically check the condition of your parcel and the good condition of the item ordered. If you notice that your parcel or your item has been damaged, please indicate this on the carrier's delivery note and contact our Customer Service Department immediately: [email protected] In your message, do not forget to mention the damage observed (wet parcel, hole, open, etc.). 

In all cases, you have a period of three (3) days, not including public holidays, from receipt of your package to notify the carrier. We also ask you to keep the shipping packaging. 

If the item(s) delivered do not correspond to your order, you may return them, in accordance with the procedures below "Return". 

ARTICLE 7 – GUARANTEES - LIABILITY

7.1. THE EMPREINTE GUARANTEE

The items on offer are in accordance with the regulations in force. They benefit from EMPREINTE expertise and quality. As a result, they are guaranteed not to have any manufacturing faults. If such a fault occurs, EMPREINTE undertakes to repair your purchase for free, or to exchange it. When an exchange takes place, faulty items are not returned. 

The EMPREINTE guarantee does not cover normal wear and tear or accidental damage, or damage caused by a washing powder or abnormal use of the garment. Machine washing harms our products and so is not included in the EMPREINTE guarantee. 7.2. LIABILITY

We are not responsible for the possible difference in "screen/reality" colour of the products. 

Moreover, we shall not be held responsible or liable for any delay or non-performance resulting from force majeure. Finally, we inform you that we cannot be held responsible for an order placed by a minor, whether or not the parents have authorised this order.

ARTICLE 8 – KEEPING DOCUMENTS

For any order over 120 euros including taxes, we undertake to keep the documents relating to the transaction for a period of 10 consecutive years. We guarantee you access at all times, on request.

ARTICLE 9 – PERSONAL DATA

Your personal data is required to process your order and is not intended to be sold, marketed or rented to third parties at any time. This information may also be used for statistical purposes, marketing analysis and customer relationship management.

If you choose to subscribe to our commercial offers, we may send you promotional offers or any news about the EMPREINTE brand by post, e-mail, SMS or telephone, depending on the media you have chosen.

EMPREINTE collects the personal data necessary for the following purposes:

You may withdraw your consent to the processing of your personal data for these purposes at any time, with the exception of the processing and tracking of orders. Your personal data is collected on behalf of EMPREINTE, in its capacity as processing manager. This data may also be passed on to our service providers located within the European Economic Area. In view of EMPREINTE's international reach and to improve the quality of our service, your personal data may be transferred outside the European Economic Area. Nevertheless, EMPREINTE guarantees that it has taken the necessary measures to ensure that your privacy and freedom are protected sufficiently to allow a secure transfer of your data. 

In any case, the information collected is strictly confidential and protected to prevent it from being distorted, damaged or accessed by unauthorised persons.

However, EMPREINTE undertakes to ensure that your personal data will not be stored for longer than is strictly necessary for the purposes described above. 

In accordance with the French Data Protection Act n°78-17 of 6 January 1978, as amended, and with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, you have the right to access, rectify, delete and transfer personal data concerning you, as well as the right to oppose and limit the processing of such data, which you may do by contacting EMPREINTE - SITE E-Commerce - 5 rue de l'Eau blanche - 29200 Brest. ARTICLE 10 – INTELLECTUAL PROPERTY

The intellectual property rights of the website and its components  (brands, designs, copyright, domain names, etc.) are subject to a right of ownership and the exclusive use of EMPREINTE. Any total or partial reproduction of the site without the express permission of EMPREINTE is prohibited, except for personal and private use, with the exclusion of commercial purposes.

ARTICLE 11 – APPLICABLE LAW - LITIGATION

These General Terms and Conditions of Sale, the order and all acts resulting from them are governed by French law. The French courts will have sole jurisdiction in the event of a legal dispute or failure of an amicable settlement.
